Legally, a divorce will give each party the right to marry again, divide the couple's assets and financial obligations and determine the future care of their children. In most states there is some form of no fault divorce. No fault divorce is a legal proceeding where divorce is granted without anyone having to show blame or fault. In no fault states, either party may be granted a divorce, even if the other party does not agree. Colorado is a no fault state. Before a divorce may be granted, there are usually five basic issues that must be resolved. They are: 1) Alimony / spousal support; 2) Marital Property distribution; 3) Custody / Parental Responsibility; 4) Visitation; and 5) Child support. If a couple agrees on how the listed issues should be resolved, then they are granted what is called an uncontested divorce. However, frequently there is disagreement on the basic issues. In this case, a contested divorce exists. When a divorce is contested, a couple is often required to go before a referee or judge to help them reach an equitable result to their points of argument.
